Lendy Terms of Use

Welcome to the Lendy Loan mobile application (hereinafter referred to as the “Application” or “Service”), operated by MONILUV TECH LIMITED (hereinafter referred to as “we,” “us,” or “Lendy”).

These Terms of Use (hereinafter referred to as the “Terms”) govern your access to and use of the Lendy Loan Application and related services.

By using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Definitions

For the purposes of these Terms:

1.Application

The Lendy Loan mobile application available on the Google Play Store, providing personal loan services.User

Any individual who registers and uses the Lendy Loan Service.Loan

A personal loan provided through the Application, ranging from GHS 300 to GHS 5,000, with loan tenures from 91 to 365 days.

2.Mobile Wallet

An active mobile payment account used by the User to receive loan disbursements and make repayments.Credit Assessment

The evaluation of a User's creditworthiness based on submitted information, credit history, and other relevant data.

2. Service Overview

Lendy is a mobile loan application designed for residents of Ghana, offering digital and convenient personal loan services.

The Service is operated by a Digital Credit Provider licensed by the Bank of Ghana (BoG) and complies with:

  • Ghana Data Protection Act, 2012
  • Google Play Store Financial Services Policies

3. User Eligibility

To use the Lendy Loan Service, you must:

  • Be at least 18 years old and legally capable of entering into contracts
  • Be a resident of Ghana with valid identification
  • Have an active mobile wallet account
  • Successfully pass Lendy's credit assessment
  • Provide true, accurate, and complete information

We reserve the right to refuse or discontinue service if these conditions are not met or if false information is provided.

4. Loan Application Process

  1. Download the Lendy Loan Application from the Google Play Store
  2. Register and complete identity verification
  3. Submit a loan application with required information
  4. Upon approval, funds are disbursed directly to your mobile wallet
  5. Loan status, fees, and repayment schedules can be viewed within the Application

Loan approval time varies depending on information completeness and credit assessment results.

5. Loan Usage

Loans may be used for legitimate purposes, including but not limited to:

  • Emergency expenses
  • Business growth
  • Personal expenses

Prohibited Use

Loans must not be used for illegal activities. Any violation may result in:

  • Account termination
  • Legal action
  • Reporting to relevant authorities

6. Loan Fees, Limits, and Repayment

6.1 Loan Fees

Loans may include:

  • Principal
  • Interest
  • Additional applicable fees

All fees are transparently displayed in the Application before loan confirmation. There are no hidden charges.

6.2 Credit Limit

  • Initial credit limits range from GHS 300 to GHS 5,000
  • Credit limits may increase with timely repayment and positive credit history

6.3 Repayment Methods

  • Repayment via mobile wallet
  • Installment repayment according to the displayed schedule
  • Early full or partial repayment is allowed without extra fees

The minimum early repayment amount is shown in the Application.

6.4 Repayment Failure

If a repayment fails, you should:

  • Ensure sufficient wallet balance and retry
  • Choose an alternative payment method
  • Contact customer@lendy2.com for support

6.5 Late Repayment and Default

Late or missed repayments may result in:

  • Late fees as displayed in the Application
  • May be reported to licensed Credit Reference Bureaus in accordance with applicable laws and regulations
  • Engagement of third-party collection agencies, All collection activities are conducted in a lawful, respectful, and non-harassing manner, in compliance with applicable laws
  • Account restrictions during default
  • Legal action where necessary

To restore credit eligibility, all overdue amounts must be cleared.

7. Data Protection and Privacy

We comply with the Ghana Data Protection Act (2012) and Google Play data security requirements.

7.1 Data Collection

We collect information necessary for:

  • Registration
  • Loan processing
  • Credit assessment

7.2 Data Use

Your data is used for:

  • Credit evaluation
  • Loan disbursement and repayment
  • Customer support
  • Legal and regulatory compliance

7.3 Data Protection Measures

  • Encrypted data transmission (SSL/TLS)
  • Restricted access to authorized personnel
  • Regular security audits

7.4 Data Sharing

Data is shared only:

8. Your Data Rights

Under the Ghana Data Protection Act, you have the right to:

9. User Responsibilities

You agree to:

  • Protect your account credentials
  • Notify us of unauthorized use
  • Comply with Ghanaian laws and these Terms
  • Avoid illegal or unauthorized use of the Service

10. Service Suspension or Termination

We may suspend or terminate your account if you:

  • Violate these Terms
  • Provide false information
  • Fail to repay loans
  • Engage in fraud or illegal activity
  • Are required to do so by law

Outstanding loans and fees remain payable after termination.

11. Disclaimer and Limitation of Liability

The Service is provided "as is" without warranties of uninterrupted operation.

We are not liable for:

  • Force majeure events
  • Indirect or consequential losses, to the extent permitted by law

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Ghana.

Disputes shall:

  1. Be resolved through amicable negotiation first
  2. If unresolved, be submitted to courts in Accra, Ghana

13. Changes to These Terms

We may update these Terms periodically.

Updates will be communicated via the Application or email and take effect upon posting. Continued use of the Service constitutes acceptance of the updated Terms.
